Terms of Service

Kervigo provides insurance back office outsourcing services to US-based insurance agencies and brokers, including but not limited to policy processing, claims management, employee benefits administration, certificate of insurance issuance, risk assessment support, and agency operations consulting (collectively, the "Services").

The specific scope, deliverables, turnaround times, and pricing for Services provided to your agency are governed by a separate Service Agreement or Statement of Work executed between Kervigo and your organization. In the event of any conflict between these Terms and a signed Service Agreement, the Service Agreement controls.

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

• Use the Site to transmit any unsolicited or unauthorized advertising or promotional material.
• Attempt to gain unauthorized access to any part of the Site or its related systems.
• Use any automated means to scrape, crawl, or extract data from the Site without prior written consent.
• Impersonate Kervigo or any of its employees, agents, or representatives.
• Use the Site in any way that could damage, disable, or impair its operation.

All content on the Site — including text, graphics, logos, service descriptions, and software — is the property of Kervigo Private Limited or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission.

Nothing in these Terms grants you any license or right to use any Kervigo trademark, trade name, or service mark.

In the course of providing Services, Kervigo may receive access to confidential information belonging to your agency, including policyholder data, carrier credentials, and proprietary workflows. Kervigo treats all such information as strictly confidential and does not disclose it to third parties except as required to perform the Services or as required by law.

Specific confidentiality obligations, data handling procedures, and security standards are detailed in the Service Agreement executed with each client agency.

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data collection and use practices.

Kervigo does not sell, rent, or trade personal information collected through the Site to third parties for marketing purposes.

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Kervigo does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Information on the Site is provided for general informational purposes only and does not constitute legal, regulatory, or professional insurance advice. You should consult qualified professionals for advice specific to your agency's circumstances.

To the fullest extent permitted by applicable law, Kervigo Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or the Services, even if Kervigo has been advised of the possibility of such damages.

Kervigo's total liability to you for any claim arising out of or related to these Terms or the Site shall not exceed the amount paid by you to Kervigo in the three months preceding the claim, or USD $100, whichever is greater. Liability caps specific to the Services are governed by the applicable Service Agreement.

You agree to indemnify, defend, and hold harmless Kervigo Private Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any third-party rights.

The Site may contain links to third-party websites. These links are provided for your convenience only. Kervigo has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them.

Kervigo reserves the right to update or modify these Terms at any time. We will indicate the date of the most recent revision at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

These Terms shall be governed by and construed in accordance with the laws applicable to Kervigo Private Limited's jurisdiction of incorporation, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction, unless otherwise agreed in a signed Service Agreement.
